Implementasi Syaru'man qablana di dalam Hukum Perkawinan

Abstract

Islam is the religion that concludes the previous revelation, and it is the judge of the laws that came before it. Any sharia that is in accordance with Islam in the previous revelation will be continued, otherwise the contrary will be rejected or adjusted to the basic values of Islam. sharia before Islam in the scope of Ushul Fiqh is called Syaru'man Qablana, it becomes part of the legal evidence in Islam. as a proposition, it is used as a guide in determining a law that previously existed in pre-Islamic peoples such as Jews and Christians.Through analysis of Islamic sources such as the Al-Quran and Hadith, this article discusses the implementation of the principle of syaru' man qablana in Islamic marriage law. Sharu' man qablana refers to the laws that were in force at the time of the previous prophets, which serve as a source of inspiration for Islamic law today.
