Fatwas, issued by scholars or authoritative institutions, play a crucial role in addressing contemporary issues that are not explicitly discussed in the Qur'an and Hadith. With the development of technology, socio-cultural, and economic factors, the demand for relevant fatwas that are in line with the context of the times has increased. However, the validity and acceptance of fatwas in society often depend on the methodology and legal approach used. The purpose of this research is to gain a deeper understanding of the position and significance of fatwas within the Islamic legal system, as well as how the methods of issuing fatwas based on the principles of usul fiqh can ensure their relevance and legal validity. This study also aims to explore the role of fatwas in accommodating the developments of the times without neglecting the primary sources of Islamic law. The methodology employed in this research is a qualitative approach, analyzing primary and secondary literature, including classical usul fiqh texts, as well as studies on contemporary fatwas. This approach aims to identify the principles of Islamic law that underpin the issuance of fatwas and how scholars apply them in modern situations. The findings of the research indicate that fatwas play a vital role in Islamic law, particularly in the context of complex modern life. Fatwas issued based on usul fiqh principles tend to be more widely accepted as they balance between dalil naqli (textual evidence) and dalil aqli (rational evidence). These findings also show that the method of issuing fatwas must continue to evolve to remain relevant and address new challenges in Muslim society, without deviating from the primary sources of Islamic law.
2024-11-30T00:00:00+07:00Copyright (c) 2025 MADZAHIBhttps://jurnal.stisalmanar.ac.id/index.php/madzahib/article/view/25Konsep Mantuq dan Mafhum dalam Perspektif Ushul Fiqih2025-09-01T17:20:05+07:00Stevia Reynata220101110051@student.uin-malang.ac.id
The interpretation of the verses of the Qur’an is an important element in understanding the meaning and purpose of the teachings conveyed. Because the Qur'an often uses terms that may be difficult to understand or different from the understanding of society in its descendant period, proper interpretation is needed so that the message and law contained can be understood comprehensively. This research aims to examine the concepts of mantuq and mafhum, two important rules in the proposal of fiqh that help reveal the express and implied meanings in the Qur'an. The research method used is library research with a qualitative approach. The result of this study is that a proper understanding of these two concepts helps to avoid errors in the interpretation and application of sharia law. In addition, the application of the concepts of mantuq and mafhum is relevant to respond to contemporary problems while still referring to the basic principles of sharia.
2024-11-30T00:00:00+07:00Copyright (c) 2025 MADZAHIBhttps://jurnal.stisalmanar.ac.id/index.php/madzahib/article/view/26Implementasi Syaru'man qablana di dalam Hukum Perkawinan2025-09-01T17:20:49+07:00Iklima Iklimaimaiklima194@gmail.com
Islam is the religion that concludes the previous revelation, and it is the judge of the laws that came before it. Therefore, he is the one responsible for meeting his family's needs. The wife is the companion of the husband and the figure of a housewife. This article uses a thematic interpretation method that includes Quranic verses as well as commentary on verses about the duties and rights of husbands and wives, as well as relevant fiqh practices for the analysis and understanding of various theories. This research discusses the principles of the Islamic family to provide a comprehensive perspective on the concept of family and its relevance to modern challenges. Agus Awalus shoimmakiina313@gmail.com
This study examines power and identity politics from the perspective of Ibn Khaldūn's thought, focusing on the ethical dimension of power relations. Ibn Khaldūn’sis seen as contradictory to democratic principles, while identity politics is viewed as ambivalent—it can strengthen solidarity but also has the potential to divide society. Using a qualitative approach through literature study, this research adopts the theories of power by Michel Foucault and Max Weber, as well as Hans-Georg Gadamer’s hermeneutic analysis method. The findings indicate that ethically grounded power fosters a healthier relationship between leaders and society. Identity politics can be positively received if explained rationally and in accordance with formal legal norms. Ibn Khaldūn’s thought offers a strong philosophical foundation for understanding the dynamics of identity politics within an Islamic context.
2024-11-30T00:00:00+07:00Copyright (c) 2025 MADZAHIB
